Board of Adjustment
The Board of Adjustment is made up of five members and two alternates appointed by the village council for three-year terms. The board meets on an as-needed basis and all board meetings are open to the to the public under N.C. Open Meetings Law.
Under the laws of the State of North Carolina, counties and municipalities are given the authority to zone property within the municipal limits. The Village of Flat Rock has developed its own zoning ordinance known as the Land Development Ordinance (LDO). The village Zoning Administrator (ZA) is responsible for interpreting and enforcing the ordinance. From time to time, questions and/or disputes may arise from decisions made by the ZA. If a decision is appealed, the Board of Adjustment is responsible for hearing the case and making a decision regarding the appeal. In addition, the board may:
- Grant variances from the requirements of the LDO
- Interpret disputed lot lines or district boundaries
- Deal with similar questions
All hearings of the Board of Adjustment are quasi-judicial, which means the board must follow rather demanding procedural rules, gather and interpret evidence, and make decisions based on specific facts of the case before it. Appeals from the board go to the Superior Court.
